2. This application for regular bail arises out of Ramgarhwa P.S. Case No. 389 of 2023, appertaining to N.D.P.S. Case No. 25 of 2024 registered for the offence under sections 8, 20(b)(ii) (C ) of the NDPS Act.
3. The prosecution case, in brief, is that on 04.10.2023, at about 05.30 PM, the informant SHO, Ramgarhwa P.S. Indrajeet Paswan, while doing vehicle checking during patrolling with the police team near Semar Chowk, saw two persons coming from Ramgarhwa Bazar side with a bag hanging in their hands who on seeing the police started running away but got apprehended on chase by the police. On asking,
Patna High Court CR. MISC. No.24080 of 2026(5) dt.16-07-2026 2/3 they disclosed their names as Lalji Das and Keshwar Das (petitioner). Thereafter, in presence of witnesses a search was made and on search from the apprehended accused Lalji Das, three notes of Rs. 100/- and two notes of Rs. 50/- and from his bag, five packets of Charas weighing about 2.500 Kg was also recovered. From search of the apprehended accused petitioner Keshwar Das, four notes of Rs. 50/- and from his bag five packets containing total 2.480 kg Charas was recovered interrogation, both apprehended accused persons disclosed that they have brought the said Charas from Nepal and they were going to Delhi to sell the same.
4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case having no criminal antecedent and is in custody since 05.10.2023.
5. Learned APP for the State vehemently opposed the prayer of bail of the petitioner and submits that commercial quantity is recovered and the trial is at the fag end as per the report of the trial court.
6. Having heard the parties and from perusal of the record, it appears that the petitioner-accused person is named in the FIR in connection with Ramgarhwa P.S. Case No. 389 of 2023 appertaining to NDPS Case No. 25 of 2024 registered under Sections 8, 20(b)(ii)© of the NDPS Act. From perusal of the

No.24080 of 2026(5) dt.16-07-2026 3/3 record, it appears that police has arrested this accused petitioner Keshwar Das and othe co-accused person namely Lalji Das and during the course of search from the bag fo this accused petitioner police has recovered huge amount of Charas. In view of the above and the fact that the commercial quantity is recovered and the trial is at the fag end as per the report of the learned Exclusive Special Judge, Court No. II (under the NDPS Act), East Champaran, Motihari, I am not inclined to grant bail to the petitioner.
7. Accordingly, the bail application of the petitioner is rejected.
8. However, since the report indicate to the fact that the trial will be completed within a period of 3-4 months, it is expected that the court below will look into the matter and will conclude the trial within a period of three months. (Alok Kumar, J) khushbu/- U T
