JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 05-01-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Section 498A, 494, 504 & 506/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.
3. Vide order dated 03.12.2020, this matter was referred to the Patna High Court Mediation Center for its resolution but from perusal of the record it appears that none of the parties appeared before the Mediator.
4. Both the parties agree to settle the dispute as one time settlement and the petitioner is ready to give Rs.12,00,000.00 (Rupees Twelve Lakhs) as one time settlement.

5. Learned counsel for the opposite party no.2 has no objection to the aforesaid.
6. In that view of the matter, with consent of both the parties, the matter is settled at Rs.12,00,000.00 (Rupees Twelve Lakhs) as one time settlement. The petitioner is directed to pay Rs.4,00,000.00 (Rupees Four Lakhs) to opposite party no.2 at the time of furnishing his provisional bail bond. The rest amount of Rs.8,00,000.00 (Rupees Eight Lakhs) shall be paid by the petitioner to the opposite party no.2 within four months thereafter. After full and final payment of Rs.12,00,000.00 (Rupees Twelve Lakhs), the provisional bail of the petitioner will be confirmed by the learned Court below.
7. It is made clear that if the petitioner fails to abide by his aforesaid undertakings, his bail bond shall be cancelled by the learned Court below.
8. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on provisional bail for a period of six months, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below

Case No. 141 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. and further subject to the undertakings given by the petitioner as stated in paragraph-6 of this order.
