The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 379/411 of the Indian Penal Code and section 8 of the Bihar Minerals (Prevention of Illegal Mining Transportation & Storage) Rules and section 40 of the BMMC Rule and section 15 of the FE Act As per the prosecution case, petitioner is alleged to be driver of the sand loaded truck which was seized by the police in this case.

It is submitted that the owner of the seized truck has already deposited the amount of Rs. 63,449/- against the penal charges as per direction of the Mines Department. Petitioner

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Banka in connection with Banka P.S. Case No. 108 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
