2. The petitioner seeks bail in a case registered for the offence punishable under Sections 467, 468, 420, 471, 506 and 34 of the Indian Penal Code.

The prosecution case, in brief, is that informant, who is retired teacher, on 09.02.2024 purchased a land measuring 15 dhurs appertaining to Khata No. 29, Plot No. 105 from this petitioner upon payment of consideration money amounting to Rs. 22,00,000/- in cash and co-accused Devendra Kumar was the identifier and co-accused Pranjal Kumar was witness of the deed. It is alleged that after some time of execution of the sale deed, some dispute arose and when the informant went to meet the accused persons, they denied. On
Patna High Court CR. MISC. No.17437 of 2025(2) dt.11-04-2025 2/3 query, informant got information that a title suit bearing T.S. No. 300 of 2017 is pending with regard to the land in question. Thereafter, the informant requested the accused persons to return the money but they refused.
4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. Petitioner is bona fide owner of the land in question for which a sale deed was executed on 08.05.1985 in his favour by one Awadh Bihari Singh. On basis of the sale deed, petitioner got his name mutated through Circle Officer on 19.03.2014 and since then he has been paying rent to the State and thus, no offence under Sections 467, 468, 420 and 471 is made out against this petitioner. Moreover, from bare perusal of the F.I.R. it is apparent that the dispute involved in the present case is civil in nature. It is further submitted that the present F.I.R. has been lodged after inordinate delay of 4 months and there is no plausible explanation for the same. Petitioner has got no criminal antecedents and he is in custody since 20.01.2025.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the facts and circumstances of the case, nature of accusation, delay in lodging of the F.I.R., period

7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Siwan in connection with Siwan Muffasil P.S. Case No. 365 of 2024.
