JUSTICE ARUN KUMAR ORAL ORDER 02-02-2018 Heard learned Counsel for the petitioners and the State. Petitioner, already in custody, seeks bail in Siwan Muffasil PS Case No. 16 of 2017 registered under Sections 302, 120(B)/34 of the IPC.

The allegation in brief is that the deceased had gone to her daughter's home and while returning back in the next morning her dead body was found thrown in a field after killing her and it is alleged that the petitioners, who are sons of the deceased, used to assault her and ask her to transfer the land in their name. Learned Counsel for the petitioners submits that the petitioners are sons of the deceased and her mother had partitioned the ancestral land by Partition Suit No. 451 of 2014, so there was no question of killing her for property. Land was not given in share to the informant therefore she has falsely implicated the petitioners in this case and the police has submitted charge sheet. Having considered the said facts and circumstances, the petitioners, namely, Pradeep Kumar and Om Prakash Prasad are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) by both of them with two sureties of the like amount each to the satisfaction of CJM Siwan in connection with Siwan Muffasil PS Case No. 16 of 2017.
