Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code read with Section 27 of the Arms Act.
The present bail application has been filed in terms of the order dated 18.01.2022 in Cr. Misc. No. 46419 of 2021 whereby liberty was given to the petitioner to renew his prayer for bail after framing of charge.
Learned counsel for the petitioner submits that the charges against the petitioner have been framed on 07.02.2022 (Annexure-5 to the bail application).
Considering the fact that charges against the petitioner
Patna High Court CR. MISC. No.18714 of 2022(2) dt.13-04-2022 2/2 have been framed, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S.Tr. No. 314 of 2019 arising out of Birpur P.S. Case No. 01 of 2018, subject to the condition that if the petitioner does not appear in the trial on two consecutive dates without any plausible explanation, the learned court below shall forthwith cancel the bail bond of the petitioner.
