ANJANA MISHRA ORAL ORDER 13-08-2015 Heard learned counsel for the petitioners and the learned counsel for the State.

The petitioners are apprehending their arrest in connection with Kahalgoan P.S. Case No.02 of 2015 for allegedly having committed the offences under Sections 341, 323, 504/34 and 302 of the Indian Penal Code.

Learned counsel for the petitioners submits that allegations against these petitioners are general and omnibus and that apparently the occurrence took place during the course of fetching water at the hand pump.

Considering the aforementioned submissions and that there has been no premeditation as stated by the learned counsel

Patna High Court Cr.Misc. No.31693 of 2015 (2) dt.13-08-2015 2/2 for the petitioners, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur, in connection with Kahalgaon P.S. Case No.02 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
