JUSTICE SANDEEP KUMAR ORAL ORDER 10-05-2023 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners seek regular bail in connection with Amnaur P.S. Case No. 337/2022, registered for the offence punishable under Sections 30/30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioners submit that the petitioners are quite innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioners. Petitioners are not arrested on the spot. They are in custody since 10.01.2023.

Learned APP has vehemently opposed the prayer for bail.

Considering the nature of allegation levelled against

Patna High Court CR. MISC. No.19446 of 2023(2) dt.10-05-2023 2/2 the petitioners, their period of custody, this application is allowed.

Let the petitioners, above named, be released on bail after framing of charge or after completion of one year, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-1st-Exclusive Special Judge, Saran, Chapra in connection with Amanaur P.S. Case No. 337/2022.

This is also subject to the conditions that (I) the petitioners would cooperate in the proceeding of the court below. In the event of failure to appear on two consecutive dates, the court below will be at liberty to pass appropriate order including cancellation of bail bonds of the petitioners and (ii) the petitioners will mark their presence in Amanaur Police Station, District- Saran at Chapra on first Sunday of every month, failing which, his bail bonds shall be cancelled by the court below. The trial court is directed to expedite the trial of all the cases which are registered against the petitioners. (Sandeep Kumar, J) Ranjeet/- U T
