The petitioners seek bail in connection with PR21/17-18 Excise 345 of 2017 dated 12.09.2017 instituted for the offences under Sections 30(a) 32(2) and 38 of the Bihar Prohibition and Excise Act, 2016.

On secret information that a huge consignment of illicit liquor is being concealed or unloaded, a raid was conducted. The petitioners were arrested from a Bolero vehicle. A truck also was found on which huge quantity of illicit liquor was kept/stacked. The total quantity of liquor recovered from the Bolero vehicle from where the petitioners were arrested and the truck was 4131.36 litres.

Patna High Court Cr.Misc. No.56958 of 2017 (3) dt.06-12-2017 Learned counsel for the petitioners has submitted that that from their possession in the Bolero vehicle, 12 cartons containing 150 ml of liquor were recovered.

The petitioners are in custody since 12.09.2017 and do not have any criminal antecedent. It has also been submitted that the Bolero vehicle does not belong to the petitioners. In the facts and circumstances, the petitioners above named are directed to be released on bail on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Muzaffarpur in connection with PR-21/1718 Excise 345 of 2017.
