The petitioners seek bail in Lakhisarai (Kabaiya) P.S. Case No. 59 of 2020, registered for the offence punishable under Sections 302/34, 201, 120(B) of the Indian Penal Code. As per the FIR, informant's mother Sharmila Devi along with co-accused Kailash Yadav and Gariban Yadav committed murder of the father of informant due to some dispute regarding sale and purchase of land.

It is submitted on behalf of petitioners that name of petitioners has come in this case during course of investigation on the basis of confessional statement of co-accused Mukesh Kumar Mahto who has been granted bail by this Court vide

Patna High Court CR. MISC. No.28529 of 2021(3) dt.06-12-2021 2/2 order dated 01.12.2020 passed in Cr. Misc. No. 26498 of 2020. Petitioner no. 1 is the husband of informant and petitioner no. 2 is cousin brother (Fufera) of petitioner no. 1. Only material that has come against petitioner no. 1 is that the sim of mobile of deceased was given to this petitioner. Petitioners are in custody since 24.03.2020 having clean antecedent.

Considering the facts and circumstances of the case, the petitioners above-named, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai (Kabaiya) P.S.
