The petitioner apprehends his arrest in connection with Special Case No.11 of 2014 (Sadar P.S. Case No. 163 of 2014) for the offences punishable under Sections 341, 342, 373, 376, 366A, 120B of Indian Penal Code, the provisions of the Immoral Traffic Act, 1956, the Juvenile Justice Act and the provisions of the Protection of Children from Sexual Offences Act, 2012. Learned counsel for the petitioner with reference to the F.I.R. has submitted that the petitioner has been arrested on mere suspicion of being involved in illegal flesh trade. He submits that there were two other similarly situated accused who moved this Court in Cr. Misc. No. 35977 of 2014 and have been granted bail on 29.8.2014 and that the case of the petitioner is on the same

The F.I.R. reflects that raids were conducted on various places by the team constituted in this regard and which led to recovery of several girls who were allegedly forced into immoral sexual trafficking. It is during such raid that the informant who is the Sub Divisional Police Officer, Sadar, Purnea gathered information that the property built up by this petitioner and some others were from usufructs of the illegal business. Learned counsel has submitted that such opinion is on mere suspicion and in absence of evidence.

Having heard learned counsel for the parties and taking note of the circumstances, let the petitioner namely, Rekha @Ajmeri in the event of his arrest/surrender within four weeks from today, be released on bail upon furnishing individual bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the 1st Additional Sessions Judge, Purnea, in connection with Special Case No.11 of 2014 (Sadar P.S. Case No. 163 of 2014) subject to the conditions stipulated under Section 438(2) of the Code of Criminal Procedure.
