Petitioner is in custody in connection with Kalyanpur P.S. Case No. 305 of 2019 for the offence under sections 272, 273/34 of the Indian Penal Code and Section 30(a), 41(1) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent.

In the instant case total 3447 liters of foreign liquor was seized.

Learned counsel submits that name of the petitioner has surfaced in the confessional statement of co-accused Kumod Das.

The petitioner is in custody since 7.1.2020.

No.19278 of 2020(3) dt.03-06-2020 2/2 Considering the fact that petitioner has remained in custody since 7.1.2020 having no criminal antecedent, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned ADJ-9th cum Special Judge Excise, East Champaran at Motihari, in connection with Kalyanpur P.S. Case No. 305 of 2019 subject to the condition that on release the petitioner has to render his service as volunteer for a period of one month in Covid-19 hospital and he is required to report to the district Nodal Officer who shall utilise the service of the petitioner appropriately.
