JUSTICE MADHURESH PRASAD ORAL ORDER 15-01-2018 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners are accused in a case registered for offence under sections 341, 323, 324, 325, 452, 504, 506, 76,511 and 34 IPC.

Counsel for the petitioners submits that they have no antecedent and have been implicated in this case due to other local considerations when they were going to watch their maize crops. Further, the allegation at best discloses the failed attempt and no case under section 376 IPC is made out against them. They are in custody since 13.7.2017. Charge sheet has also been submitted. In the facts and circumstances of the case, prayer for bail of both the petitioners is allowed. Let both the petitioners above named be released on bail on his furnishing bonds of Rs 10,000/-

Patna High Court Cr.Misc. No.1021 of 2018 (2) dt.15-01-2018 2/2 (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran Motihari in Pipra Police Station Case No. 152 of 2017 on the following conditions:- (a) One of the bailors will be a close relative of the petitioners who will give an affidavit giving genealogy as to how they are related with the petitioners.

(b) They will be well represented on each date and if they fail to do so on two consecutive dates, their bail will be liable to be cancelled.
