The petitioner seeks bail in connection with Sheohar P.S. Case No. 426 of 2025 instituted for the offence under Section 103(1) of the Bharatiya Nyaya Sanhita, 2023. 3.

The prosecution case, in short, is that the petitioner took the informant's son Amit Kumar to a blast furnace site, stabbed him, and informed the family over the victim's mobile phone that he was undergoing treatment at a hospital in Muzaffarpur.

It has been submitted on behalf of the petitioner

Patna High Court CR. MISC. No.19652 of 2026(5) dt.27-07-2026 2/3 that the petitioner is in custody since 20.11.2025. Petitioner bears no criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Learned counsel for the petitioner submits that petitioner had no intention to commit murder of the deceased as he was his childhood friend. Charge sheet has already been submitted in this case.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. There is direct allegation of stabbing the deceased against the petitioner, which is corroborated by the postmortem report. It is next submitted that at the instance of the petitioner, knife was also recovered which was used in the commission of the offence. 7.

Considering the aforesaid facts and circumstances of the case, there being direct allegation of stabbing the deceased against the petitioner, this Court is not inclined to grant bail to the petitioner. Prayer for grant of bail to the petitioner is hereby rejected.

The Trial Court is directed to expedite the trial as expeditiously as possible without any undue delay and
