JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 20-09-2022 Heard the learned counsel for the petitioners and APP for the State and perused the case diary. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 342 and 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Prosecution case is that the accused persons surrounded the son of the informant and co-accused Mahesh Mahto shot fire resulting death of the son of the informant.

Patna High Court CR. MISC. No.18790 of 2022(2) dt.20-09-2022 2/3 It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He further submits that specific allegation of shot fire is against co-accused Mahesh Mahto and not against the petitioners. Petitioners are not named in the F.I.R. The postmortem report shows that there is only one injury and cause of death is gun shot on the head of the deceased. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent.

Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submission, let the petitioners, above named, in the event of their arrest or surrender before the court below with a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial
