JUSTICE GOPAL PRASAD ORAL ORDER 04-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. This is a petition for anticipatory bail in which the petitioner is an accused for the offence under Sections 147, 148, 149, 323, 324, 307, 354, 379, 385 and 447 of the I.P.C. Learned counsel for the petitioner submits that both the parties are descendants of common ancestor and there is land dispute and the allegation against this petitioner is to have assaulted Umesh Yadav by farsa. However, two injuries have been found to be lacerated wound over frontal skull having area 4 c.m. x 1⁄2. c.m. which is simple in nature.

Hence, having regard to the facts and circumstances of the case, let the petitioner, in the event of his arrest or surrender

Patna High Court Cr.Misc. No.39112 of 2014 (2) dt.04-03-2015 2/2 before the court below within two weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Saharsa, in Sour Bazar P.S. Case no.565/13 subject to the conditions as laid down under Section 438 (2) of Cr.P.C.
