04-12-2017 Heard Sri Uday Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor.
The sole petitioner, who is in custody since 04-10-2017 in Case No. C2/550 of 2017/896 of 2017 registered for offence under Section 30 (A) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail.
At the very outset, learned counsel for the petitioner has drawn my attention to statement made in paragraph - 3 of the petition to show that petitioner is having clean antecedent. He further submits that the prosecution case itself appears to be not believable, in view of fact stated in the F.I.R. that petitioner was carrying about 130 liters of Nepali liquor, but nothing was indicated as to how petitioner was carrying such huge quantity

Besides hearing, I have also perused the material on record.
Considering the nature of accusation, clean antecedent as well as period of custody, let the petitioner namely Amit Kumar Mahto be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. - II cum Special Judge Excise Act, Sitamarhi in connection with Case No. C2/550 of 2017/896 of 2017.
