Petitioner seeks bail in Bihpur (Jhandapur) P.S. Case No.107 of 2018 instituted for the offence under Section(s) 406, 420, 379, 411/34 Indian Penal Code.

Counsel for the petitioner submits that there is no recovery of any incriminating article from the possession of this petitioner. He was not apprehended at the spot. Name of this petitioner has been disclosed by co-accused, Krishna Yadav, in his confessional statement. Seizure list is part of the First Information Report, wherein, it is mentioned that money has been recovered from the possession of Krishna Yadav, who was found sitting in the aforesaid tank-lorry. The petitioner is in custody

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Naugachiya, Bhagalpur, in connection with Bihpur (Jhandapur) P.S.
