Petitioner apprehends his arrest in connection with Sono P.S. Case No.248 of 2018 for the offence punishable under Sections 147, 149, 323, 307, 379, 447, 504 and 506 of the Indian Penal Code.

The allegation against the petitioner is that petitioner along with other co-accused assaulted the members of the family of the informant. It is further alleged that sister of the informant has been assaulted by Ravindra Yadav and co-accused Naro Yadav has assaulted Maya Devi by means of lathi due to which three upper teeth were broken.

Learned counsel for the petitioner submits that there is no specific allegation against the petitioner and no overt act has

Learned counsel for the petitioner further submits that there was dispute pertaining to road between the parties and both the parties are agnates, therefore, submission is that privilege of anticipatory bail may be granted to the petitioner. After having heard learned counsel for the petitioner as well as learned counsel appearing on behalf of the State and taking into consideration the fact that there is no specific allegation against the petitioner of making assault and further the parties are agnates having a land dispute pertaining to road, as such, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the petitioner is directed to surrender before the learned Court below within a period of four weeks and in the event of surrender by the petitioner, he shall be released on anticipatory bail by the Court below upon furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui, subject to the condition as mentioned under Section 438 (2) of Cr.P.C.
