The petitioner seeks regular bail in connection with Sasaram Town (Darigaon) P.S. Case No. 1516 of 2017 for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding the police apprehending the accused persons and thereafter recovering various quantities of illicit liquor from the motorcycles. Subsequently, on the basis of confessional statement of the co-accused, the name of the petitioner has been transpired in the present case. The learned counsel for the petitioner submits that no recovery has been effected from the person of the petitioner and,

Patna High Court Cr.Misc. No.63014 of 2017 (2) dt.17-01-2018 2/2 in fact, he has not been apprehended from the spot. It is also submitted that the petitioner has a clean antecedent and he is in custody since 03.11.2017.

Considering the nature of accusation, the period of custody already undergone and the fact that the petitioner has a clean antecedent, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge cum Special Judge, Excise, Rohtas at Sasaram in connection with Sasaram Town (Darigaon) P.S. Case No. 1516 of 2017.
