JUSTICE ARUN KUMAR ORAL ORDER 12-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Naurangia PS Case No. 4 of 2016 registered under Section 392 of the IPC. The allegation in brief is that one Bolero run in taxi was hired by FIR named accused persons but on the way the vehicle was looted by the accused persons and the driver disclosed that Adya Kewat and Munna Kushwaha had looted the Bolero vehicle.
Learned Counsel for the petitioner submits that Adya Kewat was apprehended in another bank loot case and he disclosed in his confessional statement regarding participation of some other coaccused including this petitioner and use of this Bolero vehicle and has also named the petitioner in the present case; except that there is no other material against him, has no criminal antecedent except those two cases' similarly situated other co-accused Sunil Yadav and Bipin Singh have been admitted to bail by this Court as well as by a coordinate Bench of this Court, however charge-sheet has been submitted in this case.
Having considered the said facts and circumstances, the
Patna High Court Cr.Misc. No.1440 of 2018 (3) dt.12-02-2018 petitioner, namely, Bhola Musahar @ Bhola Manjhi is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM II Bagaha in connection with Naurangiya PS Case No. 4 of 2016.
