JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-08-2015 Heard learned counsels for the petitioner and the State. The petitioner being father of the husband of the victim is apprehending arrest in a case registered for the offences punishable under Section 498A, 354/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.
The basic accusation is of torture for non-fulfillment of dowry demand whereas it is alleged against the petitioner that petitioner made an attempt to outrage the modesty of the informant.
It is submitted by learned counsel for the petitioner that maliciously the accusation has been levelled. Keeping in view of the fact that on readiness of the husband of the informant to reconcile the issue with her husband he has been granted provisional anticipatory bail vide Cr. Mis. No.31967
Patna High Court Cr.Misc. No.33110 of 2015 (2) dt.13-08-2015 2/2 of 2015, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Durgawati P.S. Case No.102 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
The bail bond of the petitioner will be accepted on filing of the affidavit by the petitioner before the learned court below, to the effect that he will never enter into the area where the informant resides with her husband. The said affidavit will be transmitted to the concerned police station.
