The petitioners have preferred this application for grant of regular bail in a case registered under section 302 and other sections of the Indian Penal Code.

As per the prosecution case, it is stated that five named accused persons including the two petitioners herein are stated to have come variously armed and of having assaulted the father of the informant leading to his death. It is submitted by learned counsel for the petitioners that the petitioners have been falsely implicated in the case. The allegations are general and omnibus in nature. They are in custody since 22.12.2020 and have no

Patna High Court CR. MISC. No.29061 of 2021(2) dt.07-12-2021 2/2 criminal antecedent. Charge sheet has been submitted in the case.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the general and omnibus allegations in the F.I.R. together with the petitioners having remained in custody for over 11 months, the Court directs the petitioners to be enlarged on bail in connection with Parsauni P.S. Case no. 106 of 2020 on each of them furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Sitamarhi.
