In this case, petitioners are seeking anticipatory bail in connection with Khagaria (Mahila) P.S. Case No. 11 of 2013, G.R. No. 917 of 2013 registered for offences under sections 323, 341, 354/34 of the Indian Penal Code.
Allegation has been made of outraging modesty of the informant and later on punching her.
The counsel for the petitioners has submitted that both the parties are close relatives and there is a land dispute between them, earlier to this present case petitioner No. 1 has filed a case, vide Gogari P.S. Case No. 176 of 2012, for offences under
Patna High Court Cr.Misc. No.37010 of 2014 (2) dt.11-02-2015 2/2 sections 448, 323, 337 and 380 of the Indian Penal Code. In view of the facts and circumstances of the case, in the event of the petitioners' arrest or surrender before the court below within four weeks from the date of communication of this order, let the above named petitioners be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Khagaria in connection with Khagaria (Mahila) P.S. Case No. 11 of 2013, subject to the condition as laid down under Section 438 (2) Cr. P.C.
