31-01-2018 Heard Sri Vasudeo Ram, learned counsel for the petitioner and Sri Ram Anurag Singh, learned Addl. Public Prosecutor.
This is the second attempt for grant of bail in Tarabari P.S. Case No. 34 of 2016, corresponding to Special Case No. 17 of 2016. Earlier, the prayer for bail of petitioner was rejected on 24-11-2016, vide Cr. Misc. No. 37302 of 2016. In this case, by order dated 17-01-2018, a report was called for from the court below, which has been received and kept at flag 'R'. The report dated 25-01-2018 sent by learned 1st Additional Sessions Judge, Araria is very much clear that out of 10 prosecution witnesses, 7 have already been examined and steps are being taken to examine remaining prosecution witnesses.
Patna High Court Cr.Misc. No.2592 of 2018(3) dt.31-01-2018 2/2 Accordingly, there is no reason to review my earlier order and the prayer for bail again stands rejected. However, considering the fact that the petitioner is in custody since long, while dismissing, it is desirable to observe that the learned Trial Judge as well as prosecution may take appropriate step so that the case may come to its logical end without unnecessary delay.
