1. Heard the parties.

2. The petitioner has prayed as under:- (I) For directing the respondent authorities specially the respondent no.2 and 3 to grant/pay Rs. 3000/- per month to the petitioner as per the clause-3 of the notification dated 31.07.2008 contained in memo no. 6530 issued under the signature of the respondent no.4 w.e.f. notification date dated 31.07.2008 to 31.01.2014 on the ground that the petitioner was discharging his duty in the Criminal Investigation Department, Bihar, Patna after getting in the rank of Inspector of police in March, 2006.

Patna High Court CWJC No.16662 of 2014(3) dt.03-01-2023 2/2 (ii) For directing the respondent authorities to implement the notification (clause-3) issued on 31.07.2008 by the Finance Department, Bihar, Patna in the case of petitioner on the ground that the petitioner fulfills the criteria for the same.

In reply to the writ petition, the respondents have pointed out that benefit of Rs.3000/- in terms of the resolution is confined to the facility for the officers working in the pay scale of Rs.18400-22400/- and above, while the petitioner was holding the post of Inspector of police in the pay scale of Rs. 6500-10500/-. Thus, he was not entitled for the claim of Rs. 3000/- per month.

4. Learned counsel for the petitioner has not challenged the said resolution.

5. Keeping in view thereto, the prayer made by the petitioner is found to be without basis.
