====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 20-07-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners seek regular bail in connection with Hajipur town P.S. Case No. 48 of 2022 lodged under Sections 413, 414, 34 of the Indian Penal Code.

The prosecution case is that upon secret information that some criminals are moving with their friends, the police has raid, upon raid 4 persons aged about 25-30 years and two persons aged about 12-13 years, started fleeing from the Gandhi Chawk, police chased them and upon arrest, they disclosed

No.19927 of 2022(2) dt.20-07-2022 2/3 their names as Ranjeet Choudhary and Dilip Choudhary, Vikash Das, Rahul Chaudhary, Suraj Chaudhary, Rajesh Choudhary and Suraj Kumar Chaudhary, upon query they disclose that they are member of mobile theft gang and from the possession of the petitioners a surgical blade was recovered. Learned counsel for the petitioners submits that except the surgical blade nothing was recovered from the present petitioners. They are in custody since 19.01.2022 having no criminal antecedent and charge sheet has already been filed in this case.

Learned counsel for the State opposes the prayer for bail.

Considering the facts and circumstances and the submissions made above of this case, let the petitioners above named, be granted bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur in connection with Hajipur P.S. Case No. 48 of 2022. The petitioners are directed to file an affidavit before the Trial Court, that they shall not involve in any criminal activities in future and they shall appear on each and every date before the Trial Court, in case of non-appearance for two

Patna High Court CR. MISC. No.19927 of 2022(2) dt.20-07-2022 3/3 consecutive dates, shall resulted into cancellation of their bail bonds. If they shall involve in such type of activities again, the prosecution shall be at liberty to move for cancellation of their bail bonds, subject to the conditions as laid down under Section 437(3) of the Cr.P.C.
