====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-09-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Katihar Muffasil P.S. Case No.58 of 2014 registered under Sections 363, 370 and 371/34 of the Indian Penal Code. The allegation of the informant is that a minor girl was being enticed away by Dilip Rishi, aged about 45 years. On suspicion, Dilip Rishi was caught by the villagers and on being asked by the villagers, Dilip Rishi disclosed that earlier, he had enticed away 4-5 children and handed over to Rajesh Rishi and Vijay Rishi (petitioner) of village-Barari Mushari Tola and in lieu thereof, Rs.5000/- per children is to be paid to him. Dilip Rishi also disclosed that he had also enticed away a minor girl

Learned counsel for the petitioner submits that, in fact, the petitioner and the informant are co-villager and due to dirty village politics, the informant had disclosed the name of the petitioner. The petitioner has no criminal antecedent. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar, in connection with Katihar Mufasil P.S. Case No.58 of 2014, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
