The petitioner is apprehending his arrest in a case registered under Section 302 of the Indian Penal Code. The prosecution case, in short, is that the brother of the informant was traceless and thereafter his dead body was found.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The name of the petitioner has transpired in the present case merely on the basis of suspicion. There is no eye witness to the alleged occurrence. Except for suspicion, there is no other substantive evidence to suggest the implication of the
Patna High Court Cr.Misc. No.51936 of 2018(2) dt.28-09-2018 2/2 petitioner in the present case.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R./complaint case. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Ara in connection with Koilwar P.S. Case No. 71 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
