The petitioner seeks bail in S.Tr. No. 523 of 2018/438 of 2018, arising out of Dhibra P.S. Case No. 7/2014, instituted for offences under Section(s) 147, 148, 149, 121(A), 120(B) of the Indian Penal Code read with Section 3⁄4 of Explosive Substance Act and 17 of CLA Act as well as Sections 38, 39 and 40 of UPA Act.

Learned counsel for the petitioner has submitted that petitioner is not named in the written report. As per prosecution case, the police arrested three persons, namely, Amrendra Yadav, Punuganju and Jagdish Ganju in suspicious condition. Learned counsel for the petitioner has submitted that name of this petitioner has been disclosed by co-accused Amrendra Kumar Yadav. There is no recovery of any incriminating article from possession of this petitioner. No T.I.P. has been held in this case.

Petitioner is in custody since 11.09.2017.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 3rd Addl. Sessions Judge, Aurangabad, in connection with S.Tr. No. 523 of 2018/438 of 2018, arising out of Dhibra P.S. Case No. 7/2014, subject to the conditions that both the bailors shall be the close relative of the petitioner.
