The petitioner apprehends his arrest in connection with Patepur P.S. Case No. 55 of 2015 registered for the offences punishable under Sections 409, 418, 419, 420 of the Indian Penal Code and Section 7 of the E.C. Act. Learned counsel for the petitioner submits that petitioner was the Block Cooperative Officer-cum- Paddy Purchase In-charge of Fathepur Block in the district of Vaishali and during his tenure, purchases were made at his level and the allegation, as made in the FIR is that he has defalcated about 802 quintals of paddy worth Rs. 10, 46, 141.85/-. It was alleged in the FIR that though the petitioner was issued reminders for depositing the aforesaid amount but

Considering the allegation made in the FIR as against him and the earlier order passed by this Court, it is directed that petitioner shall deposit 30 percent of the aforesaid defalcated amount as alleged in the FIR and in the event of such deposit being made within a period of six weeks, let the petitioner above named, in the event of his arrest or surrender before the Court below within a period of three weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in connection with Patepur P.S. Case No. 55 of 2015, subject to the conditions as laid down under Section 438 (2) of the Cr. P.C.
