JUSTICE MOHIT KUMAR SHAH ORAL ORDER 27-06-2024 The present writ petition has been filed for seeking the following reliefs:- "That the respondent No. 3 and 6 may be directed to remove the encroachment from the Public Road situated in Hemanpur Village under Mohiuddin Nagar Block, bearing Thana No. 176, Khata No. 73, Khesra No. 203, Area 2 Katha (13 decimals)."

At the outset, the learned counsel for the petitioner seeks a direction upon the District Magistrate, Samastipur and the Circle Officer, Mohiuddin Nagar, District-

Patna High Court CWJC No.5582 of 2024(2) dt.27-06-2024 2/2 Samastipur, i.e. the respondent nos. 3 and 6 to enforce the order dated 15.12.2023, passed by the respondent no. 6 in connection with Encroachment Case No. 14 of 2020-21.

Having regard to the limited prayer made by the petitioner in the present case, I deem it fit and proper to direct the respondent nos. 3 and 6 to execute the aforesaid order dated 15.12.2023, in accordance with law, in case there is no other legal impediment and the said order has not been annulled by any higher forum or court of law, forthwith. 4.

The present writ petition stands disposed off on the aforesaid terms.
