12-01-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
Petitioner, in the present case, is seeking regular bail in connection with Darbhanga Sadar P.S. Case No. 382 of 2017 registered for the offence punishable under Sections 366(A) of the Indian Penal Code, pending in the court of learned Chief Judicial Magistrate, Darbhanga. It is submitted by learned counsel for the petitioner that even if the prosecution story is believed, the girl had gone with the petitioner only with her consent.
Learned counsel for the State submits that the girl was minor and the petitioner had allured her and took away with a bad intention which this girl has also stated in her statement under Section 164 Cr.P.C.
Patna High Court Cr.Misc. No.303 of 2018 (2) dt.12-01-2018 In the facts and circumstances of the case, I am not inclined to grant regular bail to the petitioner. Accordingly, prayer for regular bail of the petitioner is rejected.
