The petitioner is accused in connection with Bakhtiarpur P.S. Case No. 195 of 2018 registered under Section 379 of the Indian Penal Code.

The accusation is that informant after withdrawing the cash of Rs.2,00,000/- from Canara Bank, Bakhtiarpur, moved to his house. In the way, he stopped his motorcycle and put the same on stand for purchasing the vegetable. In the meantime, unknown committed theft of cash of Rs.2,00,000/-, which was kept in the Dikki of the motorcycle of the informant. Learned counsel for the petitioner submits that in course of investigation, the informant and one witness identified

Patna High Court Cr.Misc. No.53942 of 2018(2) dt.19-09-2018 2/2 in the CCTV footage to this effect that petitioner was present nearby the motorcycle and except that no any tangible evidence has been collected showing the involvement in the present case. It is further submitted that petitioner is in custody since 18.05.2018.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa, in connection with Bakhtiarpur P.S. Case No. 195 of 2018. Out of two sureties, one surety must be the close relative of the petitioner.
