2. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 30 (a) of the Bihar Prohibition and Excise (Amendment) Act, 2016. 3 . It is alleged that 3750 litres country made liquor was recovered from the truk and 20 litres country made Mahua liquor was recovered from pickup van in question .

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case . Petitioner is neither owner nor driver of vehicle in question . No incriminating material has been recovered from the conscious possession of the petitioner and he is in custody

5 . Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed.

Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge Excise 1st , Aurangabad in connection with Rafiganj Police Station Case No. 103 of 2021 .
