The petitioner seeks bail in a case registered under Sections- 302, 201/34 of the Indian Penal Code. The prosecution case, in brief, is that when the informant went to see his daughter, he did not find any family members inside the house. Later on, he came to know that the petitioner who is husband of his daughter and in-laws killed his daughter Rubi Devi.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 12-12-2017 and he has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Charge sheet has already

Patna High Court Cr.Misc. No.51542 of 2018 (2) dt.18-09-2018 been submitted in this case. There is no eye witness to the alleged occurrence. The name of the petitioner has merely come on the basis of suspicion. The witnesses in course of investigation have stated that the deceased died due to illness. The other similarly situated co-accused namely, Rubi Devi, Sangeeta Devi, Rajeev Ram and Raja Ram have been granted bail by a coordinate bench of this court vide order dated 11-05-2018 passed in Cr. Misc. No. 13751 of 2018.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Samastipur in connection with Dalsingsaarai P.S. Case No. 348 of 2017 corresponding to Sessions Trial No. 190 of 2018. (Sudhir Singh, J) A.K.V./- U T
