JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-06-2019 This application, for grant of anticipatory bail, arises out of Masaurhi P.S. Case No. 619/2018, disclosing offences under Sections 147, 148, 149, 341, 323, 324, 325, 307, 337, 338, 332, 353, 153(A), 427 of the Indian Penal Code and Section 27 of the Arms Act.

Prosecution case is that due to death of a person a large number of anti social element assembled and raised slogans and also started stone pelting on a particular community. Submission of learned counsel for the petitioner is that in this case large number of persons have been made accused and though petitioner is also named in the F.I.R., but no specific allegation has been attributed to him. Heard learned A.P.P. also.

Having heard both sides, considering the submission,

Patna High Court CR. MISC. No.18672 of 2019(4) dt.26-06-2019 2/2 as above, this application is allowed. Let the petitioner, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Masaurhi, in connection with Masaurhi P.S. Case No. 619/2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
