Mr.A.G ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-01-2022 Heard learned counsel for the petitioners, the State and the opposite party no.2.

Petitioners pray for grant of regular bail in a case registered for the offence punishable under section 420 and other ancillary sections of the Indian Penal Code. Learned counsel for the petitioners submits that the petitioner is ready to pay opposite party no.2 the settlement amount of Rs.1,58,000/-. He submits that a bank draft of Rs.58,000/- will be handed over to opposite party no.2 at the time of furnishing bail bond in the Court below, whereas rest amount of one lac will be paid to the opposite party no.2 in three equal installments in further three months. Learned counsel for opposite party no.2 does not controvert the submission made by learned counsel for the petitioners.

In view of the undertaking of the petitioners, let both the petitioners, as named above, be enlarged on provisional

Patna High Court CR. MISC. No.29349 of 2021(3) dt.06-01-2022 2/2 bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Samastipur in Samastipur town Police Station Case No. 08 of 2021.

If the petitioners fulfils the undertaking, their provisional bail would be confirmed by the Court below itself, otherwise the Court below would proceed to cancel their bail bonds.
