Petitioner prays for bail in connection with Khagaria P.S.Case No. 242 of 2018 registered for the offences punishable under Sections 379, 411 and 34 of the Indian Penal Code. Allegation against the petitioner is that while committing theft of motorcycle he was arrested along with two other accused persons at the spot and motorcycle was recovered from his possession and petitioner has criminal antecedents and he has been made accused in three other cases.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case, nothing has been recovered from his conscious possession and he is in custody since 23.4.2018. Further submission is that seizure list was not prepared

Patna High Court Cr.Misc. No.52135 of 2018 (2) dt.04-10-2018 2/2 at the spot, rather at the police station.

Heard learned APP also, who has opposed the prayer for bail.

Having heard both sides and in the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner.

This application is, accordingly, dismissed.
