2. In this case, the petitioner is seeking regular bail in connection with Economic Offences P.S. Case No. 12 of 2023, registered for the offences punishable under Sections 9/20(B)(ii) (c)/25/29 of the NDPS Act, 1985.

3. As per allegation, some Ganja smugglers were going by a pick-up van and Swift Dezire Car. The police intercepted those vehicles. 100 kg of ganja was recovered from the pick-up van and 30 kg of ganja was recovered from the Swift Dezire Car. One of the miscreants disclosed his name as Rishi Tiwari and second as Ajit Rai (the petitioner). Five

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He was not involved in the occurrence. He was travelling by a Bus and he got down from the Bus in a road jam and the police arrested him.

5. On the other hand, the learned counsel for the Economic Offences Unit has opposed the prayer for bail and submitted that the petitioner was travelling by the vehicle wherefrom 30 kg of ganja was recovered. He was arrested at the spot and he has criminal antecedents of two cases of similar nature.

6. Considering the above-mentioned facts and circumstances, the petitioner does not deserve the privilege for bail, which is hereby rejected.
