JUSTICE MADHURESH PRASAD ORAL ORDER 29-11-2018 It is submitted by counsel for the petitioner that as per averments made in the counter affidavit the respondents have taken appropriate steps to ascertain the profile of the petitioner to take a decision regarding his claim particularly on the point as to whether juniors to the petitoner have been granted promotion to the post of Head Master. It is submitted that as per the counter affidavit decision upon the claim of the petitioner was to be taken after receipt of the required report form the concerned District Education Officer. In so far as grant of benefit of promotion with retrospective effect, it is submitted that as per the decision of the Hon'ble Apex Court in Civil Appeal No. 5573 of 2006 petitioner is not entitled to such benefit.
