JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-09-2018 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Sour Bazar (Patharghat O.P.) P.S. Case No. 192 of 2016 registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code.

Although, petitioners are named in the first information report but no specific overt-act has been attributed against the petitioners. There is case and counter case between the parties and it appears that occurrence took place on account of land dispute. Moreover, one co-accused, Ramanand Yadav, against whom there is allegation of assault, has already been

Patna High Court Cr.Misc. No.57224 of 2018 (2) dt.20-09-2018 2/2 admitted to anticipatory bail by a co-ordinate Bench of this court vide order dated 20.06.2018 passed in Cr. Misc. No. 21464 of 2018.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in Sour Bazar (Patharghat O.P.) P.S. Case No. 192 of 2016 subject to conditions as laid down under Section 438(2) of the Cr.P.C.
