The petitioner seeks bail in Habibpur P.S. Case No. 100 of 2020, registered for the offence punishable under Section 302/34 of the Indian Penal Code.

As per the FIR, this petitioner along with other coaccused persons committed murder of the daughter of informant. Marriage of the informant's daughter was performed with co-accused Gopal Mandal nine years back. It is submitted on behalf of the petitioner that thrust of accusation is against husband of the deceased who is already in custody. Petitioner is brother-in-law of the deceased and he is living separately much prior to marriage of the deceased with his brother Gopal Mandal and has got no concern with the family affairs of the deceased and her husband. Considering the facts and circumstances of the case and the fact that petitioner is brother-in-law of the deceased and there is general and omnibus allegation, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IX, Bhagalpur in connection with Habibpur P.S. Case No. 100 of 2020.
