The petitioner in the present case is seeking regular bail in connection with Nokha P.S. Case No. 95 of 2018 registered for the offence punishable under Section 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that on perusal of the first information report it would appear that the informant who happens to be the Officer Incharge of the Barhari O.P. and was earlier posted as Officer Incharge of Nokha Police Station has lodged this first information report alleging that after his transfer when he came to give charge to the new incumbent, he found that the wheels of several vehicles in number 36 were missing which were stolen by the unknown thieves.

Patna High Court Cr.Misc. No.51908 of 2018(2) dt.20-09-2018 2/2 Learned counsel submits that in F.I.R. itself it is stated that because of shortage of the police personnel and security guards the theft have been committed. It is submitted that the petitioner has been falsely framed in this case. Learned counsel of the State has opposed the prayer of bail.

In the given facts and circumstances of the case, let the petitioner Kalim Ahmad Ansari @ Kalim Ahmad be released on bail on furnishing bail bonds of Rs. 15,000/- (Fifteen thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Rohtas at Sasaram in connection with Nokha P.S. Case No. 95 of 2018, subject to the condition laid down under Section 437(3) Cr.P.C.
