====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 12-04-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Shambhuganj P.S. Case No.251 of 2018 registered under Section 302 of the Indian Penal Code, pending in the court of the Chief Judicial Magistrate, Banka.

The accusation against the petitioner is of causing assault through lathi at the head of the husband of the informant, who, later on died.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that the informant is not an eye witness to the occurrence and, on mere suspicion, the petitioner has falsely been implicated in this case. The

Having regard to the facts and the circumstances of the case and the nature of allegation as made against the petitioner, I am not inclined to grant bail to the petitioner and, accordingly, his prayer for grant of bail stands rejected. (Rajendra Kumar Mishra, J) P.S./- U
