2. The petitioner has renewed his prayer of bail which was rejected by this Court vide order dt. 9.1.2024 passed in Cr. Misc. NO. 36069 of 2023 in a case registered for the offence punishable under sections 8(c), 20, 22 of the N.D.P.S. Act, section 25(1-b)a, 26, 35 of the Arms Act and section 30 of the Bihar Prohibition and Excise Act.
3. It is a case of recovery of 1-kg ganja like intoxicating substance, one country made pistol, on cartridge as well as 50 liters of illicit liquor from possession of the petitioner.
4. Learned counsel for the petitioner submits that the alleged recovery of ganja like narcotic substance does not come

It is further submitted that till date, only cognizance has been taken and there is no hope to conclude the trial in near future. The petitioner is languishing in judicial custody since 1.5.2023.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Fatuha P.S. Case No. 320 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Court Excise, Patna City, District- Patna.
