Petitioner is in custody in connection with Banka P.S. Case No. 858 of 2018 for the offence under section 392 of the Indian Penal Code.

Learned counsel for the petitioner would submit that the name of the petitioner surfaced on the confessional statement of co-accused.

Learned counsel submits that petitioner is in custody since 4.1.2019 and nothing was recovered from the possession of this petitioner.

Considering the fact that petitioner was not named in the FIR and nothing was recovered from possession of the petitioner and also the fact that petitioner was although arrested

Patna High Court CR. MISC. No.17851 of 2019(2) dt.26-03-2019 2/2 on 4.1.2019 in the case in which he was not named in the FIR and he was not put on TIP, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Banka P.S. Case No. 858 of 2018.
