JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-01-2018 Heard the learned counsel for the petitioner and the learned APP for the State.
The petitioner seeks regular bail in connection with Amnaur P.S. Case No. 146 of 2017 for the offences punishable under Sections 188, 272, 273, 420, 120(B) of the Indian Penal Code and Sections 30(a) and 38/41 of the Bihar Prohibition and Excise Act, 2016.
The allegation is regarding several vehicles having been apprehended by the police and upon checking various quantities of illicit liquor were recovered, totaling 1973.520 litre As far as the petitioner is concerned, he is said to be the driver of the Bolero vehicle from which recovery of total quantity of about 336.96 litres of illicit liquors was made. The learned counsel for the petitioner submits that the petitioner is not the owner of the said Bolero vehicle and no recovery has been made from the conscious possession of the petitioner. It is further submitted that the petitioner has a clean antecedent and he is in custody since 6.10.2017. Considering the nature of accusation, the period of custody already undergone and the fact that the petitioner has a clean antecedent, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned 6th A.D.J., Saran at Chapra in connection with Amnaur P.S. Case No. 146 of 2017.
