08-12-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Madanpur P.S. Case No. 88 of 2020, registered for the offence under Section 302 & other allied sections of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, this petitioner is alleged to have caused fire-arm injury on the leg of Dhiru Kumar. It is submitted on behalf of petitioner that petitioner is not the assailant of deceased (Navin Kumar). Specific allegation of assault is against co-accused Ramesh Yadav. Petitioner is only alleged to have given fire-arm injury to Dhiru Kumar on his leg. Petitioner has got clean antecedent and he is in custody since 04.12.2020.

Learned A.P.P. for the State has opposed the bail petition.

Patna High Court CR. MISC. No.35230 of 2021(2) dt.08-12-2021 2/2 Considering the aforesaid facts and circumstances as well as period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad in connection with Madanpur P.S. Case No. 88 of 2020.
