Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 386, 353, 504, 506 and 34 of IPC.

Learned counsel for the petitioner submits that the informant (Circle Officer, Bachhwara) alleges that three revenue karamcharis were deputed for collecting toll from Jhamtia Ghat, further during the collection of toll on 27-11-2023 at 1:30 PM, 5 named accused persons threatened them. It is further submitted that near Jhamati Ghat, there is a Yadav Dhava and a medical store and the owners of Yadav Dhava and medical store are using the government land for illegal parking of vehicles and they also illegally extract toll from them, as such, Jhamatia Ghat
Patna High Court CR. MISC. No.19919 of 2025(2) dt.23-04-2025 2/3 Sairat is facing loss as the vehicles are not permitted to come inside the main entrance of Jhamatia Ghat.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that specific allegation of threat being given to the Revenue Karamchari is against the named accused persons of the FIR. It is further submitted that petitioner runs a Dhava in front of Jhamatia Ghat, as such it is being alleged that he being owner is extracting illegal money from vehicles, which get parked on the government land. It is also submitted that petitioner is not a criminal as he is a person with clean antecedent.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Bachhwara P.S.
